Terms for using BIRD.
Effective 11 September 2026. These terms govern access to the BIRD website, web and mobile applications, APIs, inspection workflows, and related services provided by MB Bird.
1. Agreement and business use
By accessing BIRD, you agree to these terms on behalf of yourself and, where applicable, the organisation that authorised your account. BIRD is intended for professional and business use. A signed order form, service agreement, or data-processing agreement takes priority where it conflicts with these online terms.
2. Accounts and access
You must provide accurate information, keep your credentials confidential, and notify us promptly of suspected unauthorised access. Accounts are personal and may not be shared. Your organisation's administrators control membership, roles, and access to organisation content. You are responsible for activity performed through your account unless caused by our breach.
3. The BIRD service
BIRD helps inspection teams capture, organise, analyse, review, and export building-condition evidence. Features may include photo and document handling, voice transcription, AI-assisted classification and drafting, report editing, and PDF export. We may improve or change features provided this does not materially reduce a paid service during its agreed term without reasonable notice.
4. Professional judgement and AI output
BIRD produces drafts and decision-support information, not engineering, legal, valuation, safety, or other professional advice. AI output can be incomplete or incorrect. A suitably qualified professional must inspect the property, verify evidence, review and correct all outputs, and approve the final report. Do not rely on BIRD as the sole means of identifying urgent hazards or regulatory obligations.
5. Customer content
You and your organisation retain ownership of inspection photographs, recordings, documents, notes, report content, and other material submitted to BIRD. You grant MB Bird a limited right to host, copy, transform, transmit, and otherwise process that content only to operate, secure, support, and improve the contracted service. We do not use customer inspection content to train general-purpose AI models.
- You must have the rights and lawful basis needed to capture and upload the content.
- Avoid recording people, private conversations, or unrelated personal information.
- Do not upload unlawful material, malware, or content that infringes another person's rights.
6. Acceptable use
You may not misuse BIRD, bypass access controls, probe or disrupt the service, introduce malicious code, reverse engineer protected parts except where law permits, scrape the service, use it to violate law or another person's rights, or use generated output deceptively. We may restrict activity that threatens the service, customers, or third parties.
7. Fees and payment
Fees, billing periods, included usage, and taxes are set out in the applicable order or agreement. Unless that agreement says otherwise, fees are exclusive of taxes and non-refundable once a billing period begins. BIRD does not currently sell digital subscriptions through the mobile application.
8. Privacy and confidentiality
Our Privacy Policy explains how we handle personal data. Each party must protect confidential information received from the other and use it only for the service relationship. Confidentiality does not apply to information that is public without breach, already lawfully known, independently developed, or lawfully received from another source.
9. Intellectual property
MB Bird and its licensors own BIRD, including its software, design, workflows, documentation, trademarks, and service-generated technology. Subject to these terms and payment of applicable fees, we grant authorised users a limited, non-exclusive, non-transferable right to use BIRD during the service term. Feedback may be used to improve BIRD without identifying you or disclosing customer confidential information.
10. Third-party services
BIRD relies on providers such as Supabase and Google Cloud and may link to services such as Google Maps. Their availability and separate terms can affect certain features. We remain responsible for our obligations to you but do not control third-party services you choose to access independently.
11. Availability and security
We use reasonable care to keep BIRD available and secure, but uninterrupted or error-free operation is not guaranteed. Planned maintenance, emergency work, internet failures, provider outages, or events beyond reasonable control may affect access. You should retain appropriate copies of final reports and maintain procedures for urgent inspection findings.
12. Suspension and termination
You may stop using BIRD and can delete your personal account from the mobile app. Your organisation's agreement determines retention and return of organisation content. We may suspend access where reasonably necessary for security, non-payment, serious misuse, or legal compliance, and will provide notice where practicable. Provisions that by nature should survive termination remain effective.
13. Warranties and liability
BIRD is provided with reasonable professional care. To the maximum extent permitted by law, implied warranties are excluded. Neither party is liable for indirect or consequential loss, lost profit, or lost business opportunity. Any aggregate liability cap stated in a signed agreement applies; otherwise, MB Bird's aggregate liability is limited to fees paid for the service during the twelve months before the event giving rise to the claim. Nothing excludes liability that cannot lawfully be excluded, including fraud or wilful misconduct.
14. Governing law and contact
These terms are governed by Lithuanian law, without regard to conflict-of-law rules. Courts in Lithuania have jurisdiction unless a binding agreement or mandatory law provides otherwise. Questions may be sent to info@birdinspect.com or MB Bird, J. Janonio g. 12A-1, LT-92252 Klaipėda, Lithuania. We may update these terms and will give reasonable notice of material changes.
